Caravans at Tregolls Cottage (KAS/EN06/00384):

As I reported to your April meeting, the enforcement procedure is still progressing. I have a copy of the witness statement sent to CC legal department which sets out in chronological order the actions taken by the Case Officer, all of which have been reported to Members previously. At the time of writing this report, I had heard nothing else but I shall report any further information I receive to your meeting.

The Paddocks, Penhalvean (PJB/EN09/00218):

I advised your April meeting that an application is to be submitted by the end of the month (April) seeking temporary permission for a caravan for three years. The application will also have justification for keeping bees, which is an agricultural use. The currently occupied storage building will be used for purposes ancillary to bee keeping and the application will also cover these uses. At the time of writing this report, I was unaware of any such application but will report anything further at your meeting.

Higher Nanpean Farm (CS/JH/EN08/00069):

As reported to your April meeting, the owner is (still!) suggesting a further planning application to retain the buildings. CC are continuing to progress Enforcement and this will be reviewed at such time as an application is received. I reported to the May meeting that Jon Pender, who was dealing with the case, has left Cornwall council and workloads are being reallocated. I have heard nothing since then. I am unaware of any planning application being submitted.

Carncrees Farm (CS/EN08/00396):

This matter remains as reported to the May meeting:

Although this particular matter is closed, as I have previously stated, I shall leave it in the report as Cornwall Council are, they say, informally monitoring the situation. Indeed, as I reported to the April meeting, they have visited the site and the caravan remains but with no evidence of occupancy. CC wish to be informed if this changes.

Static Caravan on Land opposite Tremenhere Farm (KAS/EN0900402):

As Members are aware, this caravan should have been removed by the end of February and I informed the April meeting that CC were considering "formal removal". I have been informed that a letter has been sent to the owner stating that enforcement action has been authorised and it must be removed.

Polkanuggo Farm:

As stated to the February meeting, motor cycling is allowed as a temporary use for up to 14 days in any calendar year. I trust Members will be continuing to monitor the situation over the coming months! The latest information I have (from the March Minutes) is that motorcycling activities had so far this year taken place on three occasions and that a caravan had appeared on the site. Any further update from Members will be gratefully received!

Trebarveth, Ponsanooth (KAS/EN09/00416):

As reported to the May meeting, Development Management are happy with the situation and this item will be removed from subsequent reports.

Hatchintan, Carncrees (GR/EN10/00013):

As Members are aware, the application for this site has been refused but is likely to be appealed. I shall leave the item in the report lest activities commence again.

Kennall Mill:

As reported to the May meeting, officers from conservation and Enforcement were due to visit "soon". I have heard nothing further.

Sunnyside, Foundry:

As reported to the May meeting, the building is not considered to adversely affect the amenities of the area in that its condition does not at present warrant action by the LA. The main concern is an allegation that squatters are occupying the building. I have heard nothing further.

South Cottage, South Road:

I reported to the April meeting that there appears to be small business use and was told that Enforcement were to consult Development Management about the likelihood of planning permission. I have since been told that CC do not have a case and asked for a reference number. Not having one, all I could do was refer them to the original complaint and to date I have heard no more.

Four Acres, Carn - Mr J Burton (KAS/EN10/00097):

As I reported to your May meeting, the owner has admitted that he has stayed there on occasions. He has been warned that once a month would be OK but it should only be in case of emergency. He has been made fully aware that it is not residential land.

Crane Garage, Longdowns:

The situation remains as advised to the May meeting:

As advised to the April meeting, I have requested that these premises be visited. Having had no response to my request, I sent a reminder on 29th April with another on 10th May. On 12th May I was informed that the site would be inspected and that I would be informed "in due course".

Land adjacent to Hendra Cemetery:

I have been informed that in the field owned by Miss Odette Eddy immediately in front of Meadow Court, formerly the Wesleyan Chapel which was converted into 6 dwellings in 2004, there is evidence of some sort of development starting to take place. An area of land approximately 20 metres long by 10 metres wide has been cut of grass and then pegged out and enclosed with string. I small trench has also been excavated down the middle of the site.

I have not yet contacted CC as I was awaiting any further development which may indicate what is going on.

Once again, there has been a distinct lack of updates – it seems that, despite promises that I would receive information before every meeting, I have to badger CC every time, which I have not done on this occasion to prove a point.

I will report anything further that I might receive in relation to any of the above at your meeting.

CORNWALL COUNCIL PLANNING LIAISON GROUP

DECISION REQUIRED:

To note and approve the content of the report.

To decide who should represent the Parish Council on the Local Council Planning Forum, the first meeting of which is to be held on Saturday 19th June.

 

REPORT:

As Members are aware from the minutes presented to your last meeting, a meeting with all 213 Parish and Town Councils was to be arranged with a view to setting up a Local Council Planning Forum. This was actually mooted some time ago and Cllr Barkhuysen was nominated to attend.

The Planning Liaison Group has now been disbanded and is to be replaced by the afore-mentioned forum, the first meeting of which is to take place on Saturday 19th June from 9.30am to 4pm at New County Hall. The letter of invitation is attached as Appendix 1 to this report and contains some further details.

Each Council is invited to send one representative and I ask that Members decide who should attend.

2 Local Development Framework – report back (Martin Cookman)

MC reported that the local development scheme (which sets out the framework of proposed work for the next three years) has been submitted to the Secretary of State, there are no changes so it will be published on the website soon.

Core strategy – still working on issues and options. A lot of work is going into producing evidence. We want to start the consultation process in the summer.

An important piece of work is the engagement plan, which is about how we will engage with the community. There will be three workshops, one in each delivery area, with Members – to explore ways of working with the community. Elements of these workshops will be with community network managers to assist in working with the community.

There has not been much progress with area action plans (AAPs). This is in the hands of what is happening with the regional spatial strategy (RSS). We cannot continue with the core strategy and area action plans (AAPs) until we know more about the RSS.

Q If changes to the RSS are likely, is there another plan?

A We would need a framework plan, which brings together information from documents such as the parish plans. We need to provide housing locally for growth, which is different in each area and this requires evidential information. Framework plans would fit into the core strategy.

Q Won’t local councils need a toolkit to help them with this work?

A After the general election we will know in which direction we are going, whether it be bottom up, top down or a bit of both in regard to how we deal with growth.

There is a revised development plan document (DPD) which is being presented to the planning policy advisory panel next week and to cabinet on 17 March. This will go out to consultation in May 2010. BD to circulate a copy to this group.

3 Statement of Community Involvement (Martin Cookman)

MC informed that we are currently in the process of pulling this together. This will inform how we involve the community in the local development framework as well as in the planning application process.

A draft document was presented to the planning policy advisory panel and cabinet in January 2010 and should be ready for consultation in March. We are currently bringing together all the previous district lists and cleansing the database by contacting everybody to update the information.

The consultation will be relatively formal with six weeks for comments.

NG stated that local councils receive so many consultations, it is difficult to know which ones to respond to. MC informed that they will consult through the Cornwall Strategic Partnership Engagement Group to ensure no overlap with other consultations.

 
4 Enforcement – report back (Jon Drew)

JD reported back on the five items he took previously for investigation:

·1 Guidance notes and training for local councils

·2 Fly posting

·3 Better communication

·4 Proactive work

·5 Magistrate training

Training for local councils – Members have been trained and JD and his officers are currently visiting local councils to train on enforcement. It is envisaged that they will visit each community network area in turn to provide such training. We are doing as much as we can with the resources we have.

Better communication – All local councils on email should be getting weekly update lists on enforcement cases. In some areas we have also started sending weekly lists of cases that are closed and should be able to roll this out Countywide later in the year. Officers have been asked to keep local councils updated regularly when they have an interest in particular cases.

Q Enforcement files are confidential, how can you keep people informed?

A They are confidential, but some information is available to the public. If you are unhappy with the information you receive, then contact the area enforcement officer.

Q When people report an enforcement case to Cornwall Council, sometimes it appears that nothing is being done, why is this?

A We are currently looking into what enforcement information we can report online with our new IT system, this should provide better, more up-to-date information.

Proactive work/fly posting – The intention has always been to start dealing with this in the second year of the new council and so it is hoped to start in the summer of 2010. We are currently just dealing with complaints but debating whether we do reactive/proactive work together or set up a separate team for proactive work.

NG stated that we need to be proactive on controlling work by conditions as often approvals are given subject to conditions that need to be monitored. NS informed that when discharging conditions, sometimes we need to get local councils involved. JD replied that we are committed to do proactive work, we just need to decide how to do it and in partnership with local councils. We currently carryout reactive work in regard to fly posting but this will become part of the proactive work that we wish to do.

Magistrate training – JD has spoken to colleagues in other services who have similar problems. Two members of Cornwall Council are magistrates so JD will be asking them to assist him with the problem.

JD is a member of the South West Enforcement Officers Federation who has a document on enforcement and sentences. This document is old but still relevant, so he will raise our concerns at the next meeting of the federation.

 
5 Update on Local Development Order project

BD reported:

·1 Information from research and the field studies was collated to produce a rough first draft of the Carnon Downs design guide

·2 Design principles were drafted

·3 Two officers met with other pilot authorities to discuss and explore ideas for the production of the local development order

·4 Following informal consultation, a second draft of the design guide was produced and agreed by the project team

·5 A draft local development order has been produced

·6 A graphic designer has been appointed and has produced the draft design guide for formal consultation

·7 The draft local development order has been tested against historic applications for the area and amended accordingly

·8 The draft local development order has been checked by legal services

·9 A formal four week consultation on the design guide and the local development order starts on 25 February with a public exhibition at Carnon Downs Village Hall (3-8pm on 25 February)

·10 It is planned that the Carnon Downs design guide and Carnon Downs local development order will be presented to Cabinet for adoption/approval in May 2010.

6 Local council protocol and trend of items to Committees

NS updated on proposed changes to the protocol and how it can be improved. The planning procedures panel are to consider the protocol for adoption at its meeting on 2 March and Phil Mason will update local councils following their decision.

Some local councils have been abusing this draft protocol and so measures have had to be taken. There has been quite an increase in the number of applications being taken to the area planning committees.

Q When the order of the applications on a committee agenda has changed, can this please be mentioned at the beginning of the meeting.

A Yes, we will make sure the Chairman announces any changes.

NS informed that the planning procedures panel at its next meeting will decide on changes to the current procedure for site meetings and that it is likely that where necessary, informal site visits prior to committee meetings will be introduced.

Q Can local councils speak on applications that abut or share the boundary of their parish, especially if they are consulted on such applications?

A Yes, they should be allowed to speak. NS will inform democratic services.

If a Cornwall Council member doesn’t agree with the local council on a planning application, they also have the power to request that the application be taken to planning committee for decision.

 
7 Local council comment form (on planning applications)

We want to provide local councils with some guidance notes to assist in responding to planning application consultations.

We will draft some guidance with planning officers and circulating to this group for comment, before sending to all local councils.

8 Future of this group (planning forum and workshop groups)

The group considered a discussion paper.

PA10/00119/F– Ivy Cottage – Erection of New Dwelling

REPORT:

Councillor Tisdale and I visited the site on Wednesday 10th March 2010. The proposal is to erect a new dwelling in what is currently the drive and garage area for the existing Ivy Cottage. The proposed plans do not show the existing buildings, namely a granite built garage and what appears to be a couple of block built out buildings. The first thing we noted was the area is very confined (circa 7 metres width) such that the proposed building encompasses virtually the whole area between the existing cottage and the boundary leaving less than 1 metre between properties and less than 0.25 metre to the outer boundary. The limited distance between properties would mean that both Ivy Cottage and the new dwelling would appear to have no external access to the rear garden or for maintenance. Furthermore the distance between the buildings, would be such that the new build would cut off all light to both upper and lower side windows of the existing building. We also noted that there is a side door to Ivy Cottage to which access would be severely restricted should this application be successful.

With respect to this application a number of concerns must be raised namely:

Over development of the site

No external access to either rear gardens

Obscures the windows to Ivy Cottage

No access space for maintenance of either property

The loss of rear access to Ivy Cottage for the emergency services

Design does not show the effect on Ivy Cottage regarding access/egress to the side door

The design does not show existing garage and outbuildings, presumably to be demolished?

Parking – there is no increase in car parking, in fact Ivy Cottage will have the loss of 2 spaces

Proposed car parking area poses a danger as is leads directly onto the New Road with limited view due to Rose Cottage’s high wall and hedge

There is no indication of rainwater drainage in the application

I visited the site on Oct. 1st. accompanied by Cllr. Nicholls, and met the applicant Mr.Vague. The proposal is to convert a disused granite barn into a dwelling for the use of the applicant’s parents, now retired and living in the farmhouse. The latter would then be made available to the applicant’s son and his partner, thereby satisfying a local need. The son currently lives with the applicant, using a separate caravan within the curtilage as ancillary accommodation; this would be removed should the proposal be approved, and would provide extra parking. A small block extension is proposed at right angles to the barn, roofing to match the existing slates, however, various block additions to the barn would be removed, leaving a smaller footprint than currently exists. Percolation tests are supportive, while bat and owl surveys gave negative results. Drainage will be to a new septic tank, no mains drainage being available. It is proposed to use all existing openings, installing wood grain PVC doors and windows.

A right of way exists through the farmyard, skirting the existing barn. This would be unaffected by the development.

Costings have been done for conversion to a rural workshop, holiday accommodation, and for an affordable housing unit. The calculations indicate that none of these would be economically viable at this location.

The proposal would enable the family unit on this working farm to remain and live comfortably on site, thereby reducing the need for car travel. The overall effect would be to reduce the density of existing buildings, and I propose the application be supported.

I visited the site accompanied by Tree Warden J. Lyle on Oct.3rd and met the applicant Mr Watkins. The application is to remove dead limbs to a height of 10 meters for safety reasons from two 18.5 metre high turkey oaks; these limbs overhang both the garden in which his children play and the public drive to the other houses. Some have already fallen naturally and our warden confirms that the dying of lower limbs is a natural process as the tree grows. The application is effectively to prune dead wood, which will not materially interfere with the growth or appearance of the tree. I therefore propose that the application be supported.
